Conditions of participation for competitions and surveys

1.1. Sweepstakes and surveys are organized by the Eronite Media Group (“Eronite”):

1.2. Any sponsors of the competition or survey will be announced at the time of the respective competition or survey.

1.3. The competition or survey is subject to the general terms and conditions (“Terms and Conditions”, “Conditions of Participation”) listed here.

2. competition/survey period

2.1. The period of the competition or survey will be announced with each competition. If no date or period such as “two weeks” or similar is given, the competition or survey ends with the offline publication of the corresponding page.

3. eligibility

3.1. Persons are only entitled to participate if they have reached the age of 18 and are therefore of full age. Eronite reserves the right to verify the age of participants. Employees of Eronite and/or Eronite’s distribution partners as well as their representatives, agents or other persons involved in the creation and administration of the contest or survey are excluded from participation.

3.2. All personal details of the participant must be true and correct. Otherwise, Eronite is entitled to exclude the participant from the contest or survey.

3.3. Manipulation of the competition or survey is prohibited.

3.4. Participants who do not comply with the conditions of participation may be disqualified. In such event, Eronite may not award the advertised prizes or awards or may reclaim any prizes or awards already awarded. In this case, Eronite reserves the right, in its sole discretion, to select another winner or award recipient.

4. participation in the competition or survey (“conditions of participation”)

4.1. The participation is free of charge.

4.2. To participate in the competition or survey, the participant must meet the conditions specified in the respective competition or survey, if necessary.

5th winner

5.1. The respective winners will be notified or, in the case of a survey, will receive their prize automatically.

5.2. If there are several winners, the winner will be decided by drawing lots. Prizes, on the other hand, are awarded to all participants.

6. profits and premiums

6.1. The respective prizes/rewards will be announced in the respective competition or survey. Unless otherwise stated, the prize does not include any associated costs or fees that the winner/survey participant may incur.

6.2. If for any reason Eronite is unable to award the said prize/premium or any part thereof, Eronite is entitled to award an equivalent reasonable prize/premium (“Equivalent Substitution”).

6.3. A cash payment or the exchange of the prize/premium or equivalent replacement is not possible.

7. notification of the winner/survey participant and obligation to cooperate

7.1. The winner/survey participant will be contacted by Eronite within two (2) weeks after the end of the contest period or after completion of the survey and informed about his/her win/prize. The winner/survey participant already now gives his/her consent to be contacted via the contact option provided by him/her.

7.2. If a winner/survey participant does not contact Eronite within fourteen (14) days of notification, Eronite will, on its own initiative, attempt to contact the winner using the means notified by the winner. If contact cannot be established within five (5) days, the winner/survey participant loses the claim to the prize/prize.

8. early termination of the competition or survey

8.1. Eronite reserves the right to cancel or terminate the competition/survey in its sole discretion and without prior notice.

8.2. Eronite may exercise this right in particular if there is unauthorized human intervention or if the integrity, administration, impartiality or normal operation of the Prize Draw is impaired in any way.

8.3. In the event of cancellation or termination, participants have no claim to Eronite, in particular no claim to the prizes/bonuses.

9. liability

9.1. By participating in the competition/survey, participants agree to indemnify and hold harmless employees of Eronite and/or Eronite Partners, their representatives, agents or other persons involved in the creation, administration and implementation of the competition/survey from and against any and all liability for any loss or damage of any kind – to the extent permitted by law – in and out of the context of the competition/survey, unless the damage to the participant was caused by gross negligence or wilful misconduct by an indemnified party.

9.2. In the event of slight negligence, the indemnified parties shall only be liable for the breach of an essential contractual obligation (cardinal obligation). A “cardinal obligation” is an obligation, the fulfilment of which makes the implementation of this competition/survey possible in the first place and on whose fulfilment the participant can therefore generally rely.

9.3. The liability according to point 9.2 is limited to the typical, foreseeable damages.

9.4. The indemnified parties shall not be liable for defective profits/premiums and for any subsequent damages due to the defective profits/premiums. The Indemnified Parties shall not be liable for the timely processing and transmission of the registered durations and personal data through the Website (listed in Section 4), whether due to technical or computer malfunctions, or any other technical or computer malfunctions or other errors.

9.5. The participants completely exempt the social media networks from all claims in connection with the lottery/survey. The promotion is not affiliated with the Social Media Networks and is in no way sponsored, endorsed or organized by the Social Media Networks.

10. storage of personal data and processing rules for the competition or survey

10.1. The recipient and processor of the personal data is Eronite.

10.2. By participating in the competition/survey, participants agree that their personal information collected by Eronite may be used to enable Eronite or its agents to contact participants for the purposes of the competition/survey.

10.3. The Participant may revoke its consent at any time and exercise its rights of objection, access, rectification and cancellation by sending a written notice to Eronite [contact form]. The participant acknowledges that his eligibility to participate in the competition lapses with his revocation.

11. use of image rights

11.1. The participants grant Eronite, without compensation, the rights of use for the photographs they have deposited in the social media networks in connection with or during the competition/survey. The participants undertake to comply with the terms of use and principles of the social media networks in the currently valid version, in particular not to post any pictures with racist, pornographic, political or morally offensive content in the social media networks. Eronite reserves the right, in its sole discretion, to exclude participants who violate this provision from the competition/survey without further explanation.

11.2. Eronite may use these photographs for all types of marketing activities with commercial purposes, including in modified form.

11.3. This consent can be revoked by the participant at any time by sending a message via the [contact form], whereby the participant acknowledges that his or her eligibility to participate in the game/survey ceases to exist upon revocation.

12. final provisions

12.1. Eronite’s decisions are final and no objections to them can be accepted. The judges’ decision is final.

12.2. If one of the provisions of the conditions of participation is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions of the conditions of participation. In this case, the invalid or unenforceable provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
